Please read these Terms & Conditions carefully before purchasing goods from Industrial Tech Store.

1. Definitions

  • “Company” means Industrial Tech Store. The Company refers to the legal trading entity responsible for the sale, dispatch, fulfilment, invoicing, customer support, technical assistance, warranty handling, and supply of all industrial products sold through the website or associated sales channels. This definition includes any authorised representatives or agents acting on behalf of the Company.
  • “Customer” means any person, firm, or company purchasing Goods. The Customer includes all individuals, sole traders, partnerships, limited companies, contractors, engineers, manufacturers, workshops, and commercial organisations purchasing goods from the Company, whether for direct use, resale, or integration into other systems.
  • “Goods” means all industrial, workshop, fabrication, extraction, welding, and related equipment supplied. Goods include but are not limited to machinery, welding tables, extraction systems, fabrication tools, industrial equipment, consumables, spare parts, palletised goods, bespoke items, modified products, and any other items supplied or arranged by the Company.
These Terms apply to all sales of Goods unless expressly agreed otherwise in writing by an authorised representative of the Company. No verbal agreement, informal communication, or third-party statement shall override these Terms.
These Terms constitute the entire agreement between the Company and the Customer and supersede all prior negotiations, discussions, quotations, representations, or agreements whether written or verbal.

2. Basis of Contract

  • All quotations issued by the Company are invitations to treat and do not constitute offers. Any quotation provided is for guidance only and does not create any legally binding obligation on the Company to supply Goods until a formal order has been accepted in writing or the Goods have been dispatched.
  • A contract shall be formed only upon written acceptance of the Customer’s order or dispatch of Goods. Submission of an order does not guarantee acceptance. The Company reserves the right to review, accept, reject, or modify any order prior to dispatch.
  • The Company reserves the right to refuse or cancel any order at its discretion. Orders may be cancelled due to pricing errors, stock shortages, supplier delays, payment issues, suspected fraud, or operational constraints beyond the Company’s control.
  • Errors in pricing, specifications, or product information may be corrected without liability. The Company reserves the right to correct typographical, clerical, technical, or pricing errors identified prior to dispatch without any liability to the Customer.

3. Business Customer Basis (B2B Classification)

  • The Company supplies Goods primarily to business and trade customers. Products are intended for professional, industrial, engineering, fabrication, workshop, and commercial use as well as domestic or consumer use.
  • Where a Customer is deemed a consumer under applicable law, statutory rights shall not be excluded. Nothing within these Terms is intended to exclude or limit any legal rights that cannot be excluded under UK consumer law.
  • The Customer warrants that Goods are purchased for commercial use unless otherwise agreed in writing. By purchasing Goods, the Customer confirms that products are intended for industrial, engineering, fabrication, or trade-related applications.

4. Product Information and Suitability Disclaimer

  • All product descriptions, specifications, drawings, and performance data are provided in good faith for general guidance only. Information may vary due to manufacturer updates, production changes, or supplier revisions and should not be relied upon as certified technical advice.
  • The Company does not warrant that product information is complete, accurate, or suitable for any specific application. Customers are responsible for independently verifying suitability before purchase and use.
  • Goods must be suitable for intended use. The Customer is responsible for ensuring products meet operational requirements, load ratings, environmental conditions, and application suitability.
  • Goods must be compatible with existing systems. Compatibility with machinery, electrical systems, extraction systems, or third-party equipment must be verified by the Customer.
  • Goods must comply with applicable regulations. The Customer is responsible for ensuring compliance with workplace safety regulations, legal requirements, and industry standards.
  • Goods must be installed by qualified personnel where required. Certain products require installation, commissioning, or calibration by competent and qualified professionals.
  • The Company shall not be liable for incorrect selection or application of Goods. Responsibility for specification, suitability, installation, and use remains entirely with the Customer.

5. Risk and Title

  • Risk in Goods passes to the Customer upon delivery. From the moment delivery is completed, the Customer assumes full responsibility for loss, damage, theft, or misuse.
  • Title remains with the Company until full payment is received. Legal ownership of Goods does not transfer until all outstanding payments have cleared in full.
  • The Company reserves the right to repossess unpaid Goods. Where payment has not been made, the Company may recover Goods where legally permitted.

6. Delivery

  • Delivery times are estimates only and not guaranteed. Delivery dates may vary depending on supplier schedules, courier availability, or external disruptions.
  • The Company is not liable for delays caused by external factors. This includes courier delays, transport disruption, supplier shortages, customs delays, or force majeure events.
  • Orders may be delivered in multiple consignments. Goods may be shipped separately depending on stock availability or logistical requirements.

7. Inspection and Acceptance

  • The Customer must inspect Goods upon delivery. Inspection must be carried out immediately to identify damage, shortages, or incorrect items.
  • Any issues must be reported within 72 hours. Failure to report within this timeframe may affect eligibility for claims or replacements.
  • Failure to report constitutes acceptance of Goods. If no issue is reported within the required timeframe, Goods will be deemed accepted in full working condition.

8. Installation, Use and Operational Risk

  • The Company accepts no liability for incorrect installation or use. Any guidance, documentation, or technical overviews provided by the Company do not replace the user's duty to safely set up and deploy equipment according to industry regulations.
  • Damage caused by misuse, modification, or poor maintenance is excluded. The Customer assumes all liability for component or system failures resulting from unauthorized modifications, environmental exposure, neglect, or operation outside recommended limitations.
  • Installation must be carried out by qualified personnel where required. Heavy machinery, high-voltage electrical systems, three-phase equipment, and complex ventilation infrastructure must be connected and tested exclusively by certified engineers.
  • No certification is provided unless agreed in writing. While equipment may meet various design benchmarks, formal regulatory compliance verification, site-specific certifications, or safety clearances remain the Customer's obligation.

9. Returns Policy

  • Returns are accepted at the Company’s discretion. Approval depends on product condition, supplier policies, and return feasibility.
  • Goods must be unused and in original packaging. Returned items will undergo rigorous inspection to confirm they remain in a completely clean, unsoiled, and resellable state with all factory seals and document packets intact.
  • Restocking fees of up to 25% may apply. To account for transit overheads, administrative logging, and warehouse physical inspection routines, a fee will be deducted from any processed credit notes or refunds.
  • Special-order or bespoke goods are non-returnable. Items built to customer configurations, altered from stock dimensions, ordered specifically from foreign manufacturers, or custom-fabricated are exempt from standard return paths.

10. Warranties

  • Goods are supplied with manufacturer warranty only unless stated otherwise. The Company will facilitate warranty correspondence with the original brand or production factory, but the scope, criteria, and resolution terms are dictated strictly by the manufacturer.
  • Warranty may be void due to misuse or incorrect installation. Any indications of mechanical overload, wiring errors, improper lubrication, inadequate ventilation, or general operational neglect will void any coverage claims.
  • Warranty is return-to-base unless otherwise agreed. The Customer is responsible for safely palletising, packing, and funding the transport costs required to get the equipment back to our designated facility for inspection or repair.

11. Limitation of Liability

  • No exclusion of liability for death or personal injury. Nothing in these terms limits or voids legal responsibility under UK law for negligence directly caused by the corporate body or its physical personnel.
  • No liability for indirect or consequential losses. The Company will not be held responsible for project delays, lost commercial profits, factory downtime, third-party contractor penalties, or secondary overhead fees incurred by the buyer.
  • Total liability is limited to the value of Goods supplied. The absolute ceiling for any financial legal compensation, settlement, or combination of damage payouts will never exceed the specific net invoice amount paid for the single item in question.

12. Force Majeure

  • No liability for events outside reasonable control. The Company is released from its fulfillment responsibilities if blocked by industrial action, international shipping gridlocks, extreme weather disasters, war, grid blackouts, or government trade blockades.
  • Performance may be suspended during such events. Our target shipment and response metrics will pause automatically for the duration of the external disruption, resuming as soon as regular industrial transport and supply channels clear.

13. Pricing and Variation

  • Prices may change without notice. Raw material market spikes, component tariff changes, and international freight fluctuations may cause product pricing adjustments on our channels at any given point.
  • Errors may be corrected prior to dispatch. In the case of a severe database error or mismatched pricing catalog, we maintain the absolute right to cancel the order, request complete payment, refund the customer, and correct the error before any units leave the depot.

14. Entire Agreement

This document constitutes the entire agreement between the Company and the Customer and overrides all prior communications or agreements.

15. Severability

If any provision is found invalid, the remaining provisions shall remain in full force and effect.

16. Shipping, Dispatch & Delivery

  • Orders are processed Monday–Friday excluding public holidays. Fulfillment teams, heavy freight loading teams, and parcel sorting lines do not operate outside regular weekday industrial business hours.
  • Delivery times are estimates only and not guaranteed. Variables inside courier freight networks, custom clearances, pallet tailgate availability, and route issues prevent us from promising a legally binding delivery hour or date.
  • Cut-off times apply to order processing. Orders finalized past our specified afternoon depot cut-off limit will be funneled into the subsequent business day's packaging and courier collection manifests.
  • Weekend and bank holiday deliveries are excluded unless agreed. Standard commercial freight operates on business-day cycles; premium weekend configurations must be special-quoted and cleared with dispatch staff explicitly beforehand.
  • Made-to-order products may require extended lead times. Bespoke items, custom industrial assemblies, and configured-to-order machinery undergo specific build phases and QC routines that add to standard dispatch timetables.
  • Couriers and freight providers may vary depending on shipment requirements. We utilize distinct carriers depending on parcel sizing, choosing specialized heavy flatbed or pallet haulers for industrial equipment and traditional parcel couriers for small parts.
